الجزاء التأديبي في الوظيفة العامة دراسة مقارنة

الملخص

الهدف الأساسي للعقوبات هو زجر للموظفين وتحفيزهم لأداء واجباتهم بشكل كامل وصحيح وهذا طبقاً لنطاق القواعد القانونية النافذة، وبطريقة تحقق أهداف الإدارة فى إصلاح المصلحة العامة وبتنفيذ أوامر الإدارة، وبهذا المعنى نجد أن العقوبة هى مجرد وسيلة وليست غاية للأنظمة التأديبية.


إن العقوبات الانضباطية والعقوبات التأديبية، لا تقتصر على فكرة العقاب فقط، بل غرضها أيضاً إصلاح ورفع كفاءة الموظف العام، حينما  يُدرك هذا الموظف أن كل تقصير سوف يصدر منه في واجباته الوظيفية، ينتج عنه عقوبة من الجهات المختصة بالإصلاح والتأهيل.


ونظراً لما تتمتع به جهة الإدارة العامة من سلطة تقديرية كبيرة في مجال إيقاع الجزاءات التأديبية على الموظف المخالف أو المذنب، فإنه من الممكن أن تكون هذه الجزاءات التأديبية الصادرة بحق الموظف المخالف معيبة أو غير صحيحة بإحدى العيوب التي تمس الجزاء التأديبي، أو أنها تخالف مبدأ المشروعية.
