المكانة السياسية والقانونية لمقدمات الدساتير "دراسة نماذج"

الملخص
يمثل الدستور الأساس الذي يستند إليه القانون؛ فهو يزوّد المشرّع بالموضوعات المهمة التي يقوم عليها عمل الدولة، وذلك من خلال نصوص دستورية تضع معايير محددة تُبيّن حقيقة كثير من الأمور. وبقدر تعلق الأمر بالدستور، فقد حظيت مقدمات الدساتير بمكانة كبيرة جداً، جعلت اللجان التأسيسية تسعى من خلالها إلى وضع أهداف سامية تروم تحقيقها.
كثيرةٌ هي الموضوعات التي تتضمنها مقدمات الدساتير؛ فمنها ما يفتخر بماضيه، ومنها ما يذكر معاناته ومقاومته الاستبداد، وغيرها، مما يعني عدم حصرها بما يُذكر عادةً في المقدمات. وقد ظهر اتجاهان في تحديد القيمة القانونية لهذه المقدمات: فذهب فريقٌ إلى إنكار هذه القيمة، وأكّد فريقٌ آخر وجودها. وعلى الرغم من ذلك، ظهرت لهذه المقدمات تكملةٌ في المتون عبر نصوصٍ دستورية مثّلت انعكاساً حقيقياً لمقدمات الدساتير، التي سنتعرّف عليها تباعاً.
