القصور التشريعي في مواجهة جرائم الذكاء الاصطناعي - دراسة مقارنة-

الملخص
يهدف بحثنا الراهن إلى محاولة وضع آليات تشريعية جنائية مستحدثة لمواجهة جرائم الذكاء الاصطناعي ؛ باعتبار أن التطور العلمي طوّر معه شكل الجريمة ومفهومها، لذلك سوف نتعرض لمفهوم الذكاء الاصطناعي وأهميته في المجال الجنائي ، من خلال عدة وجوه منها : تصنيف المجرمين ، والعدالة الجنائية ، والتنبؤ بالهجمات الإرهابية ، وتحديد أماكن المشتبه فيهم ، وتَوقع نسب الإجرام ، وكذلك استخدامه في معرفة أحداث الجريمة ، وتسخير الذكاء الاصطناعي وبرامجه في التحقيق الجنائي أيضًا ، ورغم مزايا الذكاء الاصطناعي إلا أنه من المتصور وجود بعض المخاطر في ارتكاب الجريمة ، ومنها : الإرهاب الإلكتروني ، والتزييف العميق ؛ لكونه أخطر آفات التكنولوجيا ، التي تصيب المجتمع البشري في عصر الرقمنة ، لذلك تنبغي مكافحة هذه الجرائم على المستوى الداخلي، من خلال الشرطة الاستباقية والأمن الوقائي ، ومن الأفضل استخدام تقنيات الذكاء الاصطناعي في ذلك ، كما يُمكن مواجهة جرائم الذكاء الاصطناعي ، بتوقيع عقوبات على الشخص الطبيعي المرتكب جريمة من جرائم هذا النوع من الجرائم كغيره ؛ وفقًا لقانون العقوبات ، وكذلك على الشخص المعنوي يتم توقيع عقوبات تلائم كيانه ووجوده، وتكمن المكافحة على المستوى الخارجي، بواسطة التعاون الدولي ، وفقًا لمبدأ تسليم المجرمين ، سواء في حال جرائم الذكاء الاصطناعي أو غيرها .
