المواجهة الجزائية لإحراق الغابات في قانون الغابات والمشاجر "دراسة مقارنة"

الملخص
يسلط هذا البحث الضوء على الآليات الجزائية التي يوظفها القانون العراقي والمقارن، وذلك لمواجهة جرائم حرائق الغابات سواء كانت هذه لاحداث تقع عمداً من قبل الجاني او نتيجة لخطأ ما، ذلك لأن الحرائق تشكل تهديداً كبيراً لمختلف الكائنات الحية ولاسيما الإنسان، إذ تسبب اضرار كبيرة بالأمن الغذائي والتنمية المستدامة والتي قد تستمر لأجيال واجيال مستقبلية مع صعوبة اجراء استصلاح التربة التي تعرضت للحرائق، حيث تهدف هذه الدراسة إلى تشخيص الثغرات في الاليات الجزائية لمواجهة حرائق الغابات واقتراح المعالجات المناسبة، وذلك من خلال تقسيم هذا البحث إلى فرعين: الفرع الأول نتناول فيه جريمة إشعال النار العمدي في الغابة، اما الفرع الثاني فنتناول فيه جريمة إحداث حريق خطأ في الغابة.
