الملخص

يهدف البحث إلى الكشف عن مدى التدهور البيئي وبشكل خاص الهيدرولوجي منه، الذي تعرضت له منطقة مجرى نهر شط العرب بعد إبرام اتفاقية الجزائر بين العراق وإيران في عام ١٩٧٥.


 إذ ركزت الاتفاقية على ترسيم الحدود النهرية وحرية الملاحة الدولية في مجرى النهر دون النظر إلى أهمية استدامة تدفق المياه العذبة وحماية البيئة المائية من التلوث وضمانها للأجيال القادمة. وفي ظل التدهور البيئي الحاد في منطقة المجرى وانعكاساته السلبية على مختلف جوانب الحياة في محافظة البصرة، واستنادًا لتغير القانون الدولي الذي ينص على ضرورة أن تشتمل الاتفاقيات المتعلقة بالأنهار الدولية على مبدأ يؤكد على ضرورة صيانة المجاري المائية واستدامة تدفق المياه العذبة والحفاظ عليها للأجيال القادمة. لذلك يمكن المطالبة بإعادة تقييم بنود اتفاقية الجزائر واجراء تعديلات تتلاءم مع التغيرات البشرية والطبيعة الكبيرة التي تعرضت لها المنطقة بعد حوالي نصف قرن من إبرامها.
